Activities during the construction of structures, as well as major repairs and reconstruction of buildings, from January 1, 2009, are regulated by SROs - self-regulatory organizations. This system replaced the construction license.

What is SRO?

In order to carry out their activities in the Russian Federation, all construction companies are required to register with an SRO. The activities of the latter are regulated by the Urban Planning Code of the Russian Federation. No. 190-FZ dated December 29, 2004.

Non-profit partnerships receive SRO status in the field of construction and reconstruction, provided they meet a number of special requirements. All this allows us to talk about a new level of responsibility, management and control.

SRO goals

The fundamental goals of creating self-regulation in construction are:

  • informing about new changes in federal laws and standards;
  • increasing the competitiveness of SRO members;
  • consideration of conflicts and disputes between members of the SRO;
  • reducing the likelihood of causing property and physical harm caused by improper performance of their work by members of the SRO.

To achieve these goals, special requirements for documents for admission to construction work are developed and approved, their issuance is carried out, and compliance with all requirements and rules regulated by self-regulation, urban planning legislation, regulatory and technical documentation is monitored.

Certificates of permission to work

All organizations specializing in construction and members of a self-regulatory organization, before starting their activities, receive special documents containing data on the types of permitted work. SRO certificates of admission to work are divided into 3 types:

  1. for construction work,
  2. for engineering surveys,
  3. to carry out design work.

These documents contain information about permitted types of work and can be issued to construction organizations indefinitely and without territorial restrictions.

Permission to construction work may be terminated in the following cases:

  • exit of an organization or individual entrepreneur from an SRO,
  • detection of violations.

Advantages of SRO

Self-regulatory organizations, as well as the procedures for their creation and control, provide for the formation of compensation and insurance funds.     From July 1, 2017, the activities of construction companies are no longer subject to licensing.     Responsibility for performing work without SRO approval

    1. For carrying out work related to the safety of capital construction without the appropriate permission, the company faces a fine of 40,000 to 50,000 rubles.
    2. If the work caused major damage to individuals, legal entities or the state, while the contractor organization enriched itself in the amount of 1.5 to 6 million rubles, its manager may be punished:
      • a fine of up to 300 rubles or equal to the income of the convicted person for a period of up to 2 years,
      • correctional labor for up to 5 years,
      • imprisonment for up to 5 years and a fine.

    For certain types of work, a building permit is not required. Whether an SRO permit is needed for your organization can be determined by reading the list below.

    These types of work do not require SRO approval for two reasons:

    • if they are carried out at simple objects and NOT carried out at particularly dangerous, technically complex and unique objects.
    • if these works, in principle, do not relate to capital construction. The list of types of work related to capital construction can be found in Order 624 of the Ministry of Regional Development dated December 30, 2009.     • installation and dismantling of engineering networks and communications (internal and external);
    • construction of special facilities (oil and gas industry, nuclear energy);
    • various installation and commissioning works;
    • construction of communication routes (roads, railways, takeoffs, underground, trams, overpasses);
    • hydraulic engineering measures (including diving);
    • masonry and installation, arrangement of furnaces;
    • organizational procedures involving the developer/customer/general contractor;
    • execution of construction control.

    How to obtain SRO permission for construction work?

    • confirm the seriousness of intentions by purchasing equipment, renting premises, providing other logistical grounds for activity;
    • submit an application to join the SRO of construction activities.

    The price for joining a construction SRO may vary depending on the policy of each professional association. As a rule, it consists of one-time payments (starting payment, deduction to the compensation fund, payment for document processing) and regular payments (membership fees). The amounts for each of these categories of expenses are determined by each SRO separately and are prescribed in their charters.
