Pensioners, migrants, people engaged in illegal business activities sell home-cooked food, herbs, seasonal vegetables and fruits, consumer goods, flowers, Muscovites can see every day near metro stations when going to or from work. Many turn a blind eye to this - it is obvious that pensioners standing in the cold and heat with their modest goods are not from a good life. At the same time, unauthorized trade is a negative social phenomenon that causes considerable harm to city residents.

The first thing that catches your eye is the appearance that unauthorized trade imposes on the city, since it is carried out using improvised means - boxes, wooden boxes, which, as a rule, are obtained from garbage containers, folding tables displayed on routes with high passenger traffic, often trade is carried out directly from the land.

Secondly, such trade is dangerous to the health and even the lives of buyers, as it is carried out without observing even basic sanitary standards. The traders do not have documents confirming the safety of food and industrial goods, nor do they have sanitary certificates confirming their health. There were precedents for people with tuberculosis engaging in food trading. Dairy products (cottage cheese, sour cream, milk), pickles, as a rule, are not packaged and are free for insects and their metabolic products to penetrate. Everyone can be convinced of this. Of course, such products are dangerous in relation to the spread of acute intestinal infections. By consuming them, you can get diseases such as dysentery, salmonellosis, and food poisoning.

Third, despite the seeming spontaneity of trade from hand, it is often orderly and well organized from the inside. So, behind a modest grandmother selling knitted hats or flowers at the metro station, there may be wholesale suppliers who have put such trade on stream. Similar facts were also identified by specialists from the district government.

The fight against unauthorized trade is carried out by specialists of the district government every day. Specialists from the district government carry out raids across the district at least twice a day in order to identify areas where unauthorized trade is concentrated. Persons trading by hand are warned of the illegality of their actions; if they refuse to stop trading, police are called in, and administrative violation reports are drawn up against violators. All information about places of unauthorized trade in the district is promptly transmitted to employees of the Shchukino district police department. In order to improve the effectiveness of combating unauthorized trade in the district, there is a mobile group to combat unauthorized trade, consisting of responsible employees of the Shchukino District Department of Internal Affairs and specialists from the district administration.

In the territory of the Shchukino district, work to suppress unauthorized trade is carried out on an ongoing basis by employees of the Department of Internal Affairs for the Shchukino district, representatives of the Public Order Security Point of the Shchukino district and the Voluntary People's Team of the Shchukino district.

According to Government Decree No. 806-PP of December 10, 2013 “On measures to suppress unauthorized trade in crowded places in the city of Moscow”, measures to control and monitor public places, along with the already listed structural units, are carried out :

  • State unitary enterprise of the city of Moscow "Mosgortrans" - within a 50-meter zone from stopping points of public urban passenger transport.
  • State Unitary Enterprise of the City of Moscow “Moscow Order of Lenin and Order of the Red Banner of Labor Metro named after V.I. Lenin" - in the lobbies of metro stations and within the 50-meter zone from metro stations.
  • State budgetary institution of the city of Moscow for the operation and repair of engineering structures "Gormost" - in under-bridge spaces, in underground pedestrian crossings, as well as within the 50-meter zone from under-bridge spaces, underground pedestrian crossings.
  • State government agency of the city of Moscow "Transportation Organizer" - within the boundaries of transport hubs, as well as within the boundaries of the 50-meter zone from transport hubs.
  • Department of Culture of the City of Moscow - on land plots, including those located within the boundaries of specially protected natural areas of the city of Moscow, provided for use by state cultural institutions of the city of Moscow - culture and recreation parks, estate museums and museum reserves, the Moscow Zoo, the Moscow Association for museum and exhibition work "Museon", subordinate to the Department of Culture of the city of Moscow, as well as within the boundaries of pedestrian zones of citywide importance in the city of Moscow.

Unauthorized trade violates about 10 federal and regional laws:

  • Article 11.1 of Moscow Law No. 45 of November 21, 2007 “Moscow City Code on Administrative Offenses.”
  • Article 14.1. Code of Administrative Offenses of the Russian Federation “Carrying out business activities without state registration or without special permission (license)”
  • Tax Code of the Russian Federation, art. 45: Tax evasion
  • Migration legislation: since a significant part of persons engaged in unauthorized trade are stateless persons of the Russian Federation.
  • Labor Code of the Russian Federation, art. 214: lack of mandatory medical examinations
  • Decree of the President of the Russian Federation dated January 29, 1992. No. 65 “On freedom of trade”: on preventing trade in unspecified places
  • Law of the Russian Federation No. 4979-1 “On Veterinary Medicine”: on the prohibition of the sale of products of animal origin that have not been subjected to veterinary and sanitary examination in the prescribed manner.
  • Federal Law “On the quality and safety of food products”, Art. 3, 20, 23: lack of documents confirming the origin and safety of products, conclusions of the state veterinary service; sellers do not undergo mandatory medical examinations and hygienic training, and do not have medical books.
  • Sanitary and epidemiological rules: violation of the rules of storage, product proximity, sales of products, sanitary standards, general requirements for the organization of trade enterprises.
  • Traffic rules, clause 12.4: violation of parking rules, because Often, persons conducting unauthorized trade use vehicles, and sometimes they themselves go out onto the road network during peak traffic congestion and offer goods to drivers.

Unauthorized trade (article of the Code of Administrative Offenses) – sale of goods or food products outside the premises:

  • from cars, trailers;
  • from self-installed tents;
  • from trays directly on the ground, sidewalks, along roads.

Pensioners, migrants, and illegal entrepreneurs are engaged in unauthorized trade. Unauthorized street trading in an unspecified location creates a negative image of the city, litters the territory, and is conducted in violation of sanitary standards.

The illusion of harmlessness of unauthorized trade

Often unauthorized trade takes place directly from the ground. Street sellers have neither permits nor health certificates confirming the safety of their purchases. Thus, during unauthorized trade there are no documents confirming the safety of food and industrial products.

Behind a grandmother selling knitted items or herbs on the street, there are often resellers who have put the trade on stream. Similar facts of unauthorized trade have been repeatedly uncovered by law enforcement officials.

District police officers carry out raids throughout the assigned territory, with the task of identifying places where unauthorized trade is present. Persons conducting illegal sales are warned of the illegality of their actions and must vacate unauthorized areas. In case of refusal, the police are called, reports of administrative violations are drawn up against the offenders, and fines are imposed for unauthorized trading.

Where to report unauthorized trading

In some cities of the country, street trading is completely prohibited. You can get information about whether trading on the streets of your city is allowed from the district consumer market department. You can complain about unauthorized trade to the district administration of the city, the Ministry of Internal Affairs (Administration or Department of Economic Security), law enforcement agencies (police), and the tax service. A complaint about unauthorized trading can also be sent to the prosecutor.

Unauthorized trade: article of the Code of Administrative Offenses of the Russian Federation

The law provides for certain liability for unauthorized trading. Carrying it out without registration by citizens of individual entrepreneurs or the status of a legal entity entails a fine for unauthorized trade from 500 to 2000 rubles.

Conducting a business without a license, if one is required, is punishable in the following order:

  • citizens can pay 2000-2500 rubles;
  • officials - 4000-5000 rubles;
  • legal entities - 40,000-50,000 rubles.

In addition to the fine, products, raw materials, and equipment are subject to confiscation. Trading activities in violation of a license (if any) entails a fine:

  • 1500-2000 rub. from citizens;
  • 3000-4000 rub. from officials;
  • 30000-40000 from legal entities.

Business activity with gross violations of the license entails the suspension of the individual entrepreneur for up to 90 days.
