Preparations for the introduction of the ban.

If you manage or are responsible for any premises or modes of transport that are subject to the new law, you must ensure that they are smoke-free. To fully meet the provisions of the law that come into force on June 1, 2014, make sure that:
No smoking signs are posted in appropriate places;
your staff, customers, clients and visitors know that the new law makes your building/vehicle “non-smoking”;
All indoor smoking rooms are closed.
You must make a number of changes to comply with the law, for example:
remove ashtrays;
announce a new smoke-free policy;
familiarize staff with the requirements of the law and outline the responsibilities of employees to comply with it.

What should I do if someone smokes in the premises I am responsible for?

Judging by the experience of other countries, it is safe to say that people will react positively to the law. However, be prepared to act if someone smokes in a “non-smoking” area or vehicle for which you are responsible. You can proceed as follows:
note smoking man at prohibitory signs and ask to put out the cigarette;
inform that smoking in in the wrong places– this is an administrative violation;
Inform the person who smokes that you are legally responsible for enforcing the smoking ban and that you both may receive a fine for breaking the law.
You may terminate service and ask a customer to leave the establishment if they continue to smoke on premises where it is prohibited by law. If your employee is violating the smoke-free law, you may want to consider enforcing disciplinary action. In case of failure to comply with legal requirements to stop smoking and/or threats of physical violence from the violator of the law, you must contact the police.

WHERE WILL SMOKING BE PROHIBITED?

“Non-smoking” workplaces and public places Almost all premises of public and workplaces, as well as some territories, fall under the scope of the new law. This means that indoor smoking areas in public places and workplaces must be closed.
From June 1, 2013, smoking is completely prohibited:
in urban and suburban transport, at transport infrastructure facilities and at the entrances to railway stations and airports;
on the territory and premises of institutions of health care, education, culture, physical education and sports;
in the premises of social services, premises occupied by authorities state power, organs local government;
at workplaces and in work areas organized on premises; non-stationary retail facilities;
in the areas of children's playgrounds and beaches; on aircraft

From June 1, 2014, smoking will be completely prohibited:
on trains long distance;
in cafes, restaurants, bars;
in hotels.

If you decide to voluntarily provide an outdoor smoking area, please note that it must meet the requirements of the authority implementing the legal regulation in the field of construction, architecture, urban planning and housing and communal services, as well as hygienic standards for the content in the atmospheric air of substances released during the consumption of tobacco products.

WHERE AND WHAT SIGNS ABOUT SMOKING PROHIBITION SHOULD BE PLACED?

The prohibition must be indicated by standard no-smoking signs, which are placed at each entrance to the site and in the premises. Signs must be in the direct line of sight of all passers-by and visitors. Smoking is prohibited on all premises educational institutions– from nurseries to universities, everyone medical institutions, including not only hospitals and clinics, but also sanatoriums, dispensaries, as well as government institutions. Smoking is prohibited in cultural and sports institutions. Smoking is prohibited in all types public transport, including train vestibules and ship decks. This category also includes train stations, airports, gas stations, and the subway.
You can smoke on the street, but at a distance of 15 meters from playgrounds and all the establishments listed above where smoking is prohibited. To inform about the 15-meter zone, we have developed a series of appropriate stickers not established by GOST. Here are some of them.

The restrictions apply not only to smoking as such, but also to the sale tobacco products. where smoking is prohibited, as well as in toilets. By decision of the owner, signs may additionally be placed in any other places.

What are the requirements for the sign?

The standard no-smoking sign is a smoking cigarette crossed out in a red circle.
The sign may be accompanied by the words “No smoking”, “Smoking is prohibited”, “No smoking” and/or information about fines for smoking in unauthorized places.
The main signs must be no less than 200 x 200 mm. Signs placed in Vehicle oh, and additional characters may be smaller in size.

The anti-tobacco law establishes those places where smoking is prohibited. Clause 5. Article 12 of the Anti-Tobacco Law provides for the placement of a sign prohibiting smoking to designate areas, buildings and objects where smoking tobacco is prohibited. Requirements to this sign and the procedure for its placement are established by the authorized Government of the Russian Federation federal body executive power.
The Ministry of Health has developed a draft of these requirements.

If the premises provide for the provision of various services, a prohibitory sign is placed at the entrance to each such premises.
Penalties for violating the anti-tobacco law: Smoking in public institutions, workplaces, in the entrances of residential buildings, train stations and airports will result in a fine of 500 to 1,500 rubles. From November 15, 2013, fines will begin to be levied for the sale of cigarettes to children and adolescents. They range from 3 to 5 thousand rubles for citizens, from 30 to 50 thousand for officials and from 100 to 150 thousand for enterprises.For smoking on children's playgrounds, fines range from 2 to 3 thousand rubles. Smoking is also prohibited in in public places, such as the entrances of residential buildings, train stations and airports, and next year platforms at railway stations, restaurants and bars will be added to them.

Addition to the law:
From June 1, a smoking ban will be introduced on long-distance trains and on suburban platforms of Russian Railways.

From June 1, 2014, paragraphs 3 and 12 of part 1 of article 12 come into force Federal Law Russian Federation dated February 23, 2013 No. 15-FZ “On protecting the health of citizens from environmental influences” tobacco smoke and the consequences of tobacco use." According to these paragraphs, smoking tobacco is prohibited on long-distance trains and on passenger platforms used exclusively for boarding and disembarking passengers during their transportation in suburban services. This prohibition does not apply to platforms used for boarding and disembarking passengers from trains during long-distance transportation.

The Ministry of Health has approved a unified standard for a smoking ban sign (Part 5 of Article 12 of the Federal Law “On protecting the health of citizens from exposure to tobacco smoke and the consequences of tobacco consumption”). Clear requirements for the placement of the sign have also been established. Appearance The smoking ban sign will now be uniform for the entire country, in contrast to the variations allowed previously. Now it is a black cigarette located in a red circle on a white background, crossed out by a red stripe. At the right end the cigarette contains 2 white stripes and smoke of a certain shape. A sign prohibiting smoking may be accompanied by text (the inscriptions “No smoking”, “No smoking”, “No smoking”).

The dimensions of the smoking ban sign are at least 200x200 mm, excluding signs placed on vehicles.

Excerpt from the appendix to order No. 340n dated May 30, 2013:

“A no-smoking sign is placed at each entrance to the territory, buildings and facilities where tobacco smoking is prohibited (on the door of vehicles), as well as in common areas (toilets).”

Requirements for a no-smoking sign and the order of its placement

1. The no-smoking sign is made in the form of an image of a certain geometric shape using various colors, graphic symbols (colorographic image) and is a circle with a red border (with the exception of the additional no-smoking sign placed in accordance with paragraph 6 of these requirements, the image of which may differ and be in a different color), the width of which must be at least 13.7 mm (appendix to these requirements). The diameter of the circle must be at least 200 mm, including the border. In the center of the circle, a graphic image of a cigarette is placed horizontally, consisting of three black rectangles. The size of the first rectangle must be at least 120 x 25 mm, the second and third - at least 6.2 x 25 mm. Rectangles are placed from left to right. The distance between the first and second rectangle must be at least 5 mm, between the second and third - at least 6.2 mm. On top of the second and third rectangles there are wavy lines at least 5 mm wide, representing smoke. The cigarette is crossed by a red transverse stripe at least 17.5 mm wide. The red transverse stripe is made at an angle of 45 degrees to the horizontal with a slope from the top left of the border to the right down to the border and should not be interrupted by the graphic symbol of the sign (cigarette).

2. A no-smoking sign placed in vehicles, as well as a no-smoking sign placed in accordance with paragraph 6 of these requirements, may be smaller sizes established by paragraph 1 of these requirements.

3. A color graphic image of a smoking ban sign is applied using various technologies to the surface of the carrier material, including metal, plastic, silicate or organic glass, self-adhesive polymer film, self-adhesive and printed paper, cardboard.

4. It is allowed to accompany the smoking ban sign with the inscriptions “No smoking”, “No smoking” and (or) information about the amount of fines for smoking.

5. A no-smoking sign is placed at each entrance to the territory, buildings and objects where smoking tobacco is prohibited (for vehicles - on the door with outside), as well as in common areas, including toilets.

In premises intended for the provision of hotel services, temporary accommodation services and (or) provision of temporary accommodation, a smoking ban sign is additionally placed near the registration point (reception service).

6. An additional sign prohibiting smoking is placed by decision of the owner of the property or another person authorized by the owner of the property in the territories and premises used for carrying out activities, including:

a) on the door of the room or in the room (for premises intended for the provision of hotel services, temporary accommodation services and (or) provision of temporary accommodation);

b) near the bar counter, in halls, including banquet halls, booths and offices (for premises intended for the provision of trade services, Catering, market premises);

c) in the vestibule (for trains);

d) in the cabin (for aircraft).

Application. No smoking sign

This "No Smoking" sign Ministry of Health of the Russian Federation No. 214n) is used when smoking can cause a fire on the doors and walls of rooms, areas where there are flammable and flammable substances, or in rooms where smoking is prohibited. PENALTY SANCTIONS (Administrative Code of the Russian Federation, Article 6.25)

Failure to comply with the requirements for a no-smoking sign, highlighting and equipment special places for smoking tobacco or failure to fulfill obligations to monitor compliance with legislation in the field of protecting the health of citizens from the effects of environmental tobacco smoke and the consequences of tobacco consumption (introduced by Federal Law of October 21, 2013 N 274-FZ)

  1. Failure to comply with the “requirements” for a no-smoking sign designating territories, buildings and objects where smoking is prohibited, and for the order of its placement, will result in penalties administrative fine for officials in the amount of ten thousand to twenty thousand rubles; on legal entities- from thirty thousand to sixty thousand rubles.
  2. Failure to comply with the requirements for the allocation and equipment of special places in the open air for smoking tobacco or the allocation and equipment of isolated premises for smoking tobacco shall entail the imposition of an administrative fine on officials in the amount of twenty thousand to thirty thousand rubles; for legal entities - from fifty thousand to eighty thousand rubles.
  3. Failure by an individual entrepreneur or legal entity to fulfill obligations to monitor compliance with legislation in the field of protecting the health of citizens from the effects of environmental tobacco smoke and the consequences of tobacco consumption in the territories and premises used to carry out their activities shall entail the imposition of an administrative fine on individual entrepreneurs in the amount of thirty thousand to forty thousand rubles; for legal entities - from sixty thousand to ninety thousand rubles.
