Pension benefits

According to Art. 17, 21, 38, 113, 114 and 115 of the Law of the Russian Federation “On State Pensions”, the state is obliged to pay a social pension to disabled children and provide various supplements to it. In 2019, the amount of social pension for disabled children is RUB 8,861.54

In addition, according to Decree of the President of the Russian Federation of March 17, 1994 No. 551, persons who are not working in connection with caring for a sick child are entitled to monthly compensation payments(EKV), the size of which should be 60% of minimum size wages.

In the case of mothers raising their children up to the age of eight, according to Art. 11 and 92(b) of the Law of the Russian Federation “On State Pensions”, pension accrual is made from the age of 50, subject to the existing work experience of at least 15 years. Benefits under labor legislation

Transport benefits

Disabled children, their parents, guardians, trustees and social workers caring for disabled children, as well as disabled people enjoy the right free travel on all types of public transport in urban and suburban transport, except taxis. These benefits apply to a person accompanying a disabled person of group I or a disabled child.

These benefits apply to a person accompanying a disabled person of group I or a disabled child.

Disabled children and their accompanying persons are given the right to free travel to the place of treatment (examination) on buses on suburban and intercity intraregional routes. Education and training of disabled children

Children and adolescents with developmental disabilities are sent to the specified educational institutions only with the consent of their parents (legal representatives) based on the conclusion of the psychological, pedagogical and medical-pedagogical commissions. Benefits for medical, sanatorium-resort and prosthetic and orthopedic services

Tax benefits

There are some provisions for parents of disabled children tax benefits. Cash payments and pensions for disabled children

According to the Federal Law of the Russian Federation of December 15, 2001. No. 166 “On state pension provision in the Russian Federation”, disabled children who permanently reside in our country have the right to receive one of the types of state pension - social pension.

  • parent (adoptive parent) or guardian (trustee) - 10,000 rubles;

  • other persons - 1200 rubles.

The right to early retirement if the child has been disabled since childhood

Mothers (fathers) of disabled children have the right to early retirement at 50 years of age, if:

  • they raised disabled children under 8 years old;

  • have at least 15 years of insurance experience.

If certain conditions are met, the time spent caring for a child is counted towards the length of service.

Labor benefits for parents of disabled children

Benefits for persons caring for a disabled child are regulated by the Labor Code of the Russian Federation.

A woman caring for a disabled child under 18 years of age has the right to establish a part-time working day or part-time working week with payment proportional to the time worked (Article 93 of the Labor Code of the Russian Federation).

Women with disabled children are prohibited:

  • send them on business trips without their consent and involve them in overtime work, work on weekends and non-working days holidays(Article 259 of the Labor Code of the Russian Federation);

  • refuse to hire them or reduce their wages on the basis that they have a disabled child;

  • fire single mothers raising disabled child under the age of 18 years at the initiative of the administration, with the exception of dismissal in connection with the liquidation of the organization or in connection with the commission of illegal actions by the employee (clauses 5-8, 10.11 of part 1 of Article 81 or clause 2 of Article 336 of the Labor Code of the Russian Federation).

Employment services are obliged to facilitate their prompt employment.

One of the parents (guardian, trustee) to care for disabled children, upon his written application, is provided with 4 additional paid days off per month (Article 262 of the Labor Code of the Russian Federation). The Labor Code of the Russian Federation is supplemented by Article 262.1 (Federal Law No. 242-FZ dated July 13, 2015), with the following content: one of the parents (guardian, trustee, foster parent) raising a disabled child under the age of 18 years is granted annual paid leave according to his desire at a time convenient for him.

At the written request of an employee raising a disabled child, the employer may grant leave without pay. The time of provision and duration of leave are determined by agreement between the employee and the employer (Articles 128, 263 of the Labor Code of the Russian Federation).

Tax benefits for disabled people from childhood

Standard tax deductions for a disabled child are provided in an increased amount (clause 4.Article 218 of the Tax Code of the Russian Federation).

The tax deduction for each month of the tax period applies to the parent (legal representative) who is supporting the child in the following amounts:

3,000 rubles - for each child if the child under 18 years of age is a disabled child or a student full-time training, graduate student, resident, intern, student under the age of 24, if he is a disabled person of group I or II. Standard tax deduction per child is given to each of the parents, and twice larger size, if the child’s only parent (guardian, guardian), or to one of the parents of their choice. Deductions when calculating tax are provided every month by subtracting the amount established by law from the tax base. A rate of 13% applies to the base reduced by the amount of the deduction.

Housing legislation (housing and land for individual housing construction for disabled children)

1. In accordance with the Housing Code, families with disabled children have the right to priority provision of residential premises.

2. According to the Federal Law “On Social Protection of Persons with Disabilities”, such families have the right to receive additional living space, which is occupied by a disabled child (if there are certain diseases), including in the form of a separate room. Such living space is not considered surplus and is subject to payment in a single amount, taking into account the benefits provided.

3. Families with disabled children have the right to free provision of land plots in state or municipal ownership, in accordance with the Law of the Voronezh Region dated May 13, 2008 No. 25-OZ “On the regulation of land relations in the territory of the Voronezh Region” for individual housing construction, farming and gardening. 4. Utility payments (housing and communal services benefits for disabled children)

Families with disabled children are provided with benefits for utility bills in the form of discounts:

  • from payment of apartments and utilities in houses of the state, municipal and public housing stock - not less than 50%;

  • when living in residential buildings that do not have central heating, a discount is provided on the cost of fuel purchased within the limits established for sale to the public;

  • telephone subscription fee – 50% discount.

Families with disabled children have the right to receive additional measure social support for payment of housing, utilities, payment and delivery of fuel established by the Law of the Voronezh Region, in the form monetary compensation in accordance with the order of the Department of Labor and Social Development of the Voronezh Region dated August 12, 2013 N 2772/OD, which approved the Procedure for providing monetary compensation for the payment of housing and (or) utilities to certain categories of citizens in the Voronezh Region.

Traveling on public transport with disabled children

Disabled children, their parents, guardians and trustees caring for disabled children have the right to free travel on public passenger vehicles (except for taxis and minibuses of the Gazelle type) on suburban routes, as well as intercity routes (in the absence of a suburban route within the administrative district) in accordance with the Decree of the Administration of the Voronezh Region dated January 30, 2006 No. 49 “On the procedure for implementing preferential travel for certain categories of citizens.

Also, the state provides disabled children with a 50% discount on the cost of travel on intercity transport lines: air, rail, river, road.

Benefits for the education of disabled children

Disabled children have priority over other categories of citizens for placement in preschool institutions. Moreover, everything is created there the necessary conditions and rehabilitation measures for their stay. If, for health reasons, a disabled child cannot be in a general preschool, then a special preschool institution is selected for him.

Parents can also refuse to educate children with disabilities in a state preschool institution and educate the child at home, or send him to a non-state educational institution.

When entering a higher educational institution, a disabled person from childhood has a preferential right to enrollment, subject to successfully passing the entrance examination.

General information about children's disabilities

To obtain the right to benefits for families with children suffering from certain functional disorders, they must first of all have a medical examination of the presence of pathologies. institution. What benefits are available to working parents?

Parents of a child with a disability or his guardians should be provided with housing, tax, social, labor and other preferences.

According to the Russian Labor Code, working parents/guardians of children with limited bodily functions are provided with special benefits:

  • in addition to paid leave of 14 days at your own expense at any time (Article 263);
  • one of the parents, with a certificate from the social security authorities and an application, is given 4 paid free days every month (more details in Article 262);
  • The parent of a disabled child should not be left at work beyond the established norm, on weekends, holidays, night shift, as well as to be sent on business for several days without his consent in writing (Article 259);
  • labor benefits for working single mothers of disabled children imply the impossibility of dismissing such an employee due to staff reduction; by decision of the employer, and even in the event of liquidation of the enterprise, she must find a similar place of work (Article 179).

The employer has no right to deduct money or days from annual leave the father or mother of a disabled person, even if such an employee exercised his right to 4 paid days off per month and 2 weeks of unpaid leave. But management can reduce wages based on hours worked if the employee worked part-time/week.

If a child has been certified as disabled, then benefits and benefits for him and his relatives, adoptive parents, and guardians will include, first of all, cash payments.

In 2019, the pension for all disabled minors is the same: 12,681 rubles. Adults with disabilities have been paid a pension by group since childhood: 10,361 rubles. (1st group), 9919 (2nd group) and 4215 (3rd group).

Thus, the family of a disabled child (relatives, adoptive parents or guardian) can receive up to 19,801 rubles monthly. (pension plus EDV, NSU and additional payment for care).

If a disabled person was adopted, the adoptive family receives one-time assistance - 118,529 rubles.

Social services

A disabled person must receive monthly NSS. It includes:

  • prescription medications, honey products, medicinal baby food in the amount of more than 760 rubles;
  • an annual voucher to a sanatorium, but if a sick child does not need resort treatment, he is entitled to 118 rubles monthly;
  • free travel once a year to the place where the boarding house is located and back (monthly equivalent - 110 rubles).

If a child or disabled since childhood 1st gr. cannot travel to the place of resort treatment on their own, the state must pay for accommodation and round-trip travel for one accompanying person.

Students with disabilities should be fed free of charge in the school canteen. They may be allowed to study at home, take the Unified State Exam in a gentle manner, etc.

Preferences in the housing and communal services sector

Housing benefits for families with disabilities include a 50% discount on rent and utilities, 50% on the cost of fuel (if there is no central heating). The exception is houses not from the state fund.

If serious chronic pathologies do not allow a child to be kept in the existing living space, his parents have the right to demand from the state its expansion within the limits established by law.

Housing benefits also include the right of such a family to receive priority land plot, where you can build a house for yourself, plant a garden, or a vegetable garden.

Other privileges
